Preamble
The website www.mistertemp-group.com (the “Site”) is the corporate website of the Mistertemp’ Group, a network of temporary employment and recruitment agencies operating in particular under the Mistertemp’, Aquila RH, Lynx RH and Vitalis Médical brands, and developed in part as a franchise.
These general terms of use (the “Terms”) set out the conditions under which any User may access and use the Site. They supplement the legal notice and the privacy policy, available at the bottom of every page of the Site.
Article 1 – Definitions
In the Terms, the following terms have the meaning given below, in the singular as in the plural:
- “Publisher”: the company ALPHYR, identified in the Legal Notice section of the Site.
- “Site”: the website available at www.mistertemp-group.com, its subdomains and all of its pages and content.
- “User”: any natural or legal person who accesses or uses the Site, whatever their status (internet user, candidate, client company, prospective franchisee, journalist, etc.).
- “Content”: all the elements present on the Site, in particular texts, articles, images, photographs, videos, logos, trademarks, key figures, graphics, software and databases.
- “Contributions”: any information or data submitted by the User through the Site, in particular by means of a form.
- “Services”: the features offered by the Site, described in article 5.
- “Network”: all the agencies operated under the group’s brands, directly or by independent franchisees.
Article 2 – Acceptance and enforceability of the Terms
Accessing and using the Site implies the User’s full and complete acceptance of the Terms. The User acknowledges having read them and having the legal capacity to accept them.
When a form is submitted, the User is invited to expressly accept the Terms, for example by ticking a box provided for this purpose. A User who does not accept the Terms must refrain from using the Site.
The applicable Terms are those online on the date the Site is consulted. They may be printed and saved at any time.
The Network agencies operated as franchises are companies legally independent of MisterTemp’ Group. Each is solely responsible for its business, in particular for its direct relationships with its temporary workers, candidates and clients.
Article 3 – Description of the Services
The Site is intended to provide information and to put people in contact. In particular, it allows the User:
- to consult information about the group, its history, its brands, its locations, its CSR commitments and its key figures;
- to consult editorial content: news, blog articles, press releases and press room, testimonials, videos;
- to contact the Publisher by means of a contact form;
- to submit a request for information or an application to join the Network as a franchisee;
- to access the group’s whistleblowing system;
- to access, through links, the websites of the group’s brands and the Publisher’s social networks;
The information published on the Site, in particular the key figures (number of agencies, of people placed in employment, of contracts, revenue), is provided for information purposes only. It has no contractual value and constitutes neither an offer nor a commitment by the Publisher.
Article 4 – Access to the Site
The Site is accessible free of charge to any User with internet access. The costs related to access (hardware, software, internet subscription) are borne exclusively by the User, who is solely responsible for the proper functioning of their equipment.
The Publisher endeavours to make the Site accessible 24 hours a day, 7 days a week. It is bound only by an obligation of means. Access may be suspended, limited or interrupted, without notice or compensation, in particular for maintenance or update operations, or in the event of technical failure, security incident or force majeure.
The Publisher may at any time modify, enrich or delete all or part of the Site, its Content or its Services, without incurring any liability.
Article 5 – Forms and applications
The User undertakes to provide accurate, complete and up-to-date information concerning them personally, or concerning the entity they are authorised to represent. Mandatory fields are marked with an asterisk; if they are not filled in, the request cannot be processed.
The User guarantees that their Contributions do not infringe any third-party rights and do not contain any unlawful content. The Publisher may decline to follow up on any request that is incomplete, manifestly erroneous, abusive or contrary to the Terms.
The Site’s forms include a checkbox by which the User agrees to be contacted by the Publisher, and where applicable by the Network agency concerned by their request, by telephone, email or SMS, using the contact details they have provided. This box is never pre-ticked: the User must tick it themselves, freely and knowingly. It is separate from the acceptance of the Terms.
The User may withdraw their consent at any time, free of charge and without giving reasons. They simply need to use the unsubscribe link included in each email or write to protectiondesdonnees@mistertemp.com. Withdrawal does not affect the lawfulness of contacts already made.
Submitting a franchise application via the Site is a simple expression of interest. It constitutes neither an offer, nor a promise, nor a commitment to contract on the part of the Publisher, which remains free not to follow it up without having to give reasons for its decision.
Any franchise relationship is preceded by the provision of a pre-contractual information document, at least twenty days before the signing of the contract, in accordance with articles L. 330-3 and R. 330-1 of the French Commercial Code, and is the subject of a separate contract. The market studies, forecasts or examples of results mentioned on the Site are indicative and do not guarantee any revenue or profitability.
Any job offers published are posted by the Publisher or by the Network agencies. Their publication does not constitute a commitment to hire. Applications are forwarded to the entity that issued the offer, which is solely responsible for the recruitment process, in compliance with articles L. 1132-1 et seq. of the French Labour Code on non-discrimination.
Article 6 – User obligations and conduct
The User undertakes to use the Site fairly, in accordance with its purpose, the Terms and the regulations. In particular, the User shall not:
- use the Site for unlawful, fraudulent or unauthorised commercial purposes, or for purposes contrary to public order and morality;
- transmit content that is defamatory, insulting, discriminatory, violent or pornographic, that incites hatred or that infringes the privacy or rights of third parties;
- impersonate a third party or provide false information;
- send unsolicited messages (spam) or mass communications via the forms;
- fraudulently access or attempt to access the Site, its servers or non-public areas;
- introduce viruses, malicious code or any program likely to harm the Site;
- carry out any systematic extraction, harvesting or reuse of the Content (scraping, robots), including to train artificial intelligence systems, without written authorisation;
- disrupt or overload the operation of the Site.
Such conduct may constitute criminal offences, in particular within the meaning of articles 323-1 et seq. of the French Criminal Code. In the event of a breach, the Publisher may, without notice, delete the Contributions concerned, block the User’s access to the Site and take any appropriate action.
Article 7 – Intellectual property
The Site and all of its Content, as well as its structure, site map and graphic charter, are the exclusive property of the Publisher or of the companies of its group, or are used under licence. They are protected by the French Intellectual Property Code and international conventions.
The trademarks and logos:
- Mistertemp’,
- Mistertemp’ Group,
- Aquila RH,
- Lynx RH,
- Vitalis Médical
- Mistertemp’plus
as well as the trademarks of the partners appearing on the Site are protected trademarks.
The User is authorised to consult the Site and to print or download extracts of Content for strictly personal and non-commercial use, provided that the source is mentioned and the extracts are not modified.
Any other reproduction, representation, adaptation, translation, distribution or exploitation, in whole or in part, by any means whatsoever, without the prior written authorisation of the Publisher, is prohibited and constitutes an infringement punishable under articles L. 335-2 et seq. of the French Intellectual Property Code. The same applies to the extraction or reuse of a substantial part of the Site’s databases (articles L. 342-1 et seq.).
Article 8 – Liability
The Publisher implements reasonable means to ensure the accuracy and updating of the information published on the Site, without being able to guarantee its completeness or the absence of errors or omissions. This information may be changed at any time.
The Publisher cannot be held liable in the event of:
- interruption, malfunction or inaccessibility of the Site, whatever the cause;
- intrusion, virus or any damage caused to the User’s equipment;
- use of the Site that does not comply with the Terms;
- a decision taken by the User solely on the basis of the information on the Site;
- acts attributable to a third party, in particular to the franchised agencies of the Network, or to a case of force majeure within the meaning of article 1218 of the French Civil Code.
In any event, the Publisher is liable only for direct and foreseeable damage. These limitations do not apply in the event of gross negligence or wilful misconduct, to personal injury, or where prohibited by law.
The User is solely responsible for their use of the Site and for their Contributions. The User shall indemnify the Publisher against any claim or action by third parties resulting from a breach of the Terms on their part.
Article 9 – Protection of personal data, cookies and trackers
Personal data collected via the Site are processed by ALPHYR, as data controller, in accordance with the conditions set out in the Privacy Policy section of the Site.
Article 10 – Whistleblowing system
The Site provides access to the group’s whistleblowing system, set up in accordance with French law no. 2016-1691 of 9 December 2016, known as “Sapin II”, as amended by law no. 2022-401 of 21 March 2022. This system is governed by its own procedure, accessible from the Site, which specifies who may make a report, the guarantees of confidentiality and the protection granted to whistleblowers.
The system must be used in good faith. Any abusive report or report made in bad faith may expose its author to disciplinary sanctions and to prosecution, in particular for malicious false accusation (article 226-10 of the French Criminal Code).
Article 11 – Security
The Publisher implements appropriate technical and organisational measures to ensure the security of the Site and of the data processed, in particular the encryption of exchanges (HTTPS protocol). As the internet is not a fully secure network, the User acknowledges that absolute security cannot be guaranteed and undertakes to take appropriate measures to protect their own equipment.
Article 12 – Links and third-party sites
The Publisher can in no event be held liable for the technical availability of websites or mobile applications operated by third parties (including any partners) that the User may access through the Site and/or the Application. The Publisher accepts no liability for the content, advertising, products and/or services available on such third-party websites and mobile applications, which, it should be remembered, are governed by their own terms of use. Nor is the Publisher responsible for transactions between the User and any advertiser, professional or merchant (including any partners) to which the User may be directed through the Site and/or the Application, and it can in no event be a party to any disputes whatsoever with these third parties concerning, in particular, the delivery of products and/or services, or the guarantees, representations and other obligations of any kind by which these third parties are bound.
Article 13 – Force majeure
The Publisher cannot be held liable for a failure resulting from a case of force majeure within the meaning of article 1218 of the French Civil Code and French case law, including in particular telecommunications network failures, large-scale cyberattacks, decisions by the authorities or natural disasters.
Article 14 – Amendment of the Terms
MisterTemp’ Group may amend the Terms at any time, in particular to take account of legal, regulatory, case-law or technical developments, or of changes to the Services offered. The amended Terms come into force as soon as they are published online, the date of update appearing at the top of the document. The User is invited to consult them regularly.
Article 15 – Miscellaneous provisions
- Partial invalidity: if any provision of the Terms is declared null or inapplicable, it is deemed unwritten and the other provisions retain their full effect.
- No waiver: the fact that the Publisher does not invoke a breach does not constitute a waiver of the right to invoke it subsequently.
- Language: the Terms are drawn up in French. In the event of translation, only the French version is authoritative.
- Entire agreement: the Terms, the Legal Notice, the Privacy Policy and the cookie management policy together form the rules applicable to the use of the Site.
Article 16 – Applicable law and dispute resolution
The Terms are governed by French law, wherever the Site is used.
In the event of a dispute relating to the interpretation or performance of the Terms, the parties will seek an amicable solution. The User sends their written claim to the Publisher, at its registered office or via the contact form.
Failing an amicable agreement, any dispute will be submitted to the competent courts within the jurisdiction of the Versailles Court of Appeal, subject to the mandatory rules of jurisdiction applicable to consumers.
